Planning applications and outcomes 2022-2025

ECAG has been involved in many VCAT cases over the past few years, each requiring involvement in anything from two to five or six days of VCAT proceedings.

While many applications have eventually been granted a permit, in virtually all cases the final approved plans and permit conditions as directed by VCAT have resulted in a far better outcome than would have been the case if ECAG had not objected and Nillumbik Council had not refused the original application proposal.

In some cases VCAT added to the permit conditions proposed by Council to require more details of the proposed colours and materials for a development following ECAG’s advocacy on this issue at VCAT.

2025

644 Main Rd and 6 Mt Pleasant Rd, Eltham
Application for increase in veterinary practitioners from 2 to 4, construction of additional veterinary centre building, construction of new car park on 6 Mt Pleasant Rd.
VCAT Hearing May 2024, Permit granted in VCAT Decision Order April 2025.

22 Cecil St, Eltham
Application for 5 double storey townhouses (14 bedrooms). Permit refused by VCAT March 2025. (Second VCAT refusal for a similar proposal on the site).

860 Main Rd, Eltham
Application for Childcare Centre. Agreement by Council and ECAG on changes made by the applicant resulted in a VCAT Consent Order March 2025.

7 Macaulay Court, Eltham
Application for 3 dwellings refused a permit by Council March 2025. (Another similar proposal for 3 dwellings was refused a permit by VCAT June 2022).

1343 Main Rd, Eltham
Application for 10 double storey dwellings and removal of 65 trees (28 requiring a permit). ECAG lodged an objection. Refused a permit by Council on 3 February 2025.

28 Taylor St, Eltham
Application for two double storey 3 bedroom plus study dwellings approved by VCAT March 2025.

Application for a Childcare Centre for 110 children granted a permit by VCAT December 2024.

1113-5 Main Rd, Eltham
Application for Childcare Centre granted permit by VCAT October 2024.

25 Brisbane St, Eltham
Application for a 3 storey development of 36 storage units, 24 factory units, offices and a cafe granted a permit by VCAT August 2024.

66 Park Rd, Eltham
Application for 4 double storey townhouses (14 bedrooms).Both ECAG and a representative of local residents attended VCAT with Council to oppose the granting of a permit in an area that was subject to a significant landscape overlay. Permit refused by VCAT July 2024.

62A Brougham St, Eltham
Application for 21 dwellings approved by VCAT April 2024.

22 Arthur St and 25 Dudley St, Eltham
Application for two 4 to 5 storey buildings comprised of apartments, commercial premises and a 2 level underground carpark was granted a permit by VCAT in February 2024. VCAT had previously (February 2019) refused a similar but slightly larger proposal.

Application for 5 single storey dwellings approved by VCAT January 2024.

Third application, to amend the plans to 8 dwellings (from the 7 approved) granted a permit by VCAT November 2023.
